Planning Considerations

The planning officer, Christopher Poad, addressed the concerns raised in the letters of objection in the Fanshaw House Report.

The report noted that the proposed development would result in the provision of three self-contained residential units, contributing positively towards Hackney's, and London's, housing needs, in line with Policy LP12 (Meeting Housing Needs and Locations for New Homes) of the Hackney Local Plan 2033 (LP33) and policy H1 of the London Plan (2021).

The proposed development would provide the following dwelling size mix:

  • 1 x 1bedroom
  • 1 x 2bedroom
  • 1 x 3bedroom

The report stated that given the proposed mix, with the proposal providing a family-sized unit, in a sustainable location, the proposal would satisfy the objectives of Policy LP14 of the LP33.

The report also stated that Policy LP13 (Affordable Housing) of the LP33 requires that schemes for 1-9 residential units provides on-site provision or payments in-lieu up to the equivalent of 50 per cent of housing delivered as affordable housing, subject to viability. In this instance there would be a requirement of £150,000 to be secured as an affordable housing financial contribution to make the proposal policy compliant. The applicant has signed the Council's Small Sites Agreement confirming their acceptance to pay the required £150,000 financial affordable housing contribution.

The report concluded that the proposed development was acceptable in planning terms.

Conditions

The planning permission was granted subject to the following conditions:

  • Commencement within three years
  • Development in accordance with plans
  • Submission of material details
  • Submission of detailed drawings
  • Submission of a Construction Management Plan (CMP)
  • Compliance with Non-Road Mobile Machinery (NRMM) Low Emission Zone requirements
  • Submission of a scheme to address the risks associated with site contamination
  • Submission of a detailed layout, cross sections, full specifications and a detailed management and maintenance plan of the biodiverse roof
  • Green roofs shall not be used for any purpose other than as a means of escape in emergency or for maintenance of the building
  • The noise level from all plant and machinery included in the approved development shall at all times remain 10dB(A) below background levels when measured at any nearby residential window
  • Submission of precise details of the proposed cycle parking provision
  • Submission of precise details of the proposed refuse and recycling storage capacity
  • Provision of two bee bricks and two swift boxes close to the eaves prior to first occupation
  • Submission of details to demonstrate that the consented standards have been met for the Air Source Heat Pump
  • Submission of details to demonstrate that the consented standards have been met for providing a minimum MVRH exchange rate of 0.5ac/h in habitable rooms
  • The applicant shall provide a statement to confirm that the development has been designed to be water efficient and reduce water consumption as far as possible

The above recommendation was subject to the landowners and their mortgagees entering into a Legal Agreement by means of a legal deed in order to secure the following matters:

  • Affordable Housing Financial Contribution of £150,000
  • Residential Car Free Development (Non-Blue Badge Holders)
  • Construction Management Plan
  • Carbon Offset Payment of £2,565 (subject to review)
  • Monitoring costs of £7,165 in accordance with the Planning Contributions SPD (2020) to be paid prior to completion of the proposed legal agreement

Ashenden Road Planning Application

The sub-committee granted planning permission for the erection of a bin store and planters within the front garden and replacement of front brick boundary wall at 72 Ashenden Road, subject to conditions.

The application, 2025/1051, was for the erection of a bin store and planters within the front garden and replacement of front brick boundary wall and installation of a bike.

Planning Considerations

The planning officer, Zarreen Hadadi, stated in the 72 Ashenden Road Report that the principle of undertaking residential extensions and alterations is in accordance with planning policy at local, regional and national levels, subject to assessments of other material considerations.

The report noted that the previously existing front brick boundary treatment has been demolished as it was damaged and the wall requires replacement. The surrounding front boundary treatments along Ashenden Road and Trehurst Street are varied in style, materials and height.

The report also noted that there are numerous examples of bike and bin storage structures within close proximity to the site including Nos.2, 13, 57, 61 Trehurst Street and No. 48, 70, 72 Adley Street.

The report concluded that the proposed development was acceptable in planning terms.

Conditions

The planning permission was granted subject to the following conditions:

  • Commencement within three years
  • Development in accordance with plans
  • All new brick external finishes shall match the existing building
  • The external doors of the cycle and refuse enclosures shall be closed and fixed shut at all times when the enclosures are not in use
