Summary
The Licensing Committee of Chesterfield Borough Council is scheduled to meet on 1 October 2025 to discuss several items, including a review of the council's Statement of Licensing Policy. The committee will also review the minutes of the previous meeting held on 8 January 2025.
Review of the Council's Statement of Licensing Policy
The main item for discussion is the review of the council's Statement of Licensing Policy, as mandated by the Licensing Act 2003, which requires the licensing authority to review and publish a statement at least every five years. Chesterfield Borough Council's last statement was published in 2021.
The report pack includes a copy of the proposed draft revised Statement of Licensing Policy, and highlights the changes to the previous policy:
- Updating the date of the Council's Plan to 2023-2027.
- Amending details relating to Pavement Licensing, updating the fee and length of licence.
- Updating details related to the public spaces protection order which has replaced the designated public places order1.

- Updating the list of acceptable accredited qualifications for a personal licence.
The report pack indicates that the Licensing Committee will be asked to approve the Draft Statement of Licensing Policy prior to a consultation with individuals, businesses, and authorities related to the Licensing Trade, and other Interested Parties.
The report pack outlines a timetable for the approval of the Statement of Licensing Policy:
- Consultation starting 6 October 2025 and ending 2 November 2025.
- Any comments to be referred to the Licensing Committee in November 2025.
- Cabinet consideration on 16 December 2025.
- Full Council consideration on 17 December 2025.
- Publication of the Statement of Licensing Policy in January 2026.
The report pack states that the draft Policy will be circulated to various Responsible Authorities, including: Chesterfield Borough Council Licensing, Derbyshire Safeguarding, Fire, Health and Safety, Health and Safety Executive, Planning, Police, Pollution, Trading Standards, Primary Care Trust, The Navigation Authority, The Environment Agency, and The Home Secretary. It will also be circulated to businesses and residents (via Council Forums), local Councillors, the British Beer and Pub Association, Pub Watch, Solicitors, Premises Licence Holders of premises in the Cumulative Impact Zone (CIZ area), and Premises Licence Holders of Late Night Refreshment premises in the CIZ area.
The report pack indicates that any comments received from the consultation will be considered by the Licensing Section and referred back to the Licensing Committee. If no comments are received, the revised Statement of Licensing Policy may not need to go before the Licensing Committee a second time.
