The Licensing Sub-Committee Hearing Panel is scheduled to convene to consider a number of premises licence applications and temporary event notices which have attracted objections. These include applications relating to Flawd, Burger Box and Casa Mia.
Flawd, 9 Keepers Quay - Application to Vary a Premises Licence
The panel will consider an application to vary a premises licence for Flawd, located at 9 Keepers Quay, Manchester, M4 6GL.
The applicant, DJR Food and Beverage Limited, is seeking to vary condition 1 of Annex 3 of their licence, which currently states:
The external area shall cease to be used for drinking and dining at 9pm daily.
The proposed variation would extend this time to 11pm daily.
According to the report pack, this application has received 25 representations, including one from Manchester City Council (MCC) Licensing and Out of Hours Compliance Team, and 24 from local residents.
The Licensing and Out of Hours Compliance Team initially objected to the application, raising concerns about potential noise disturbance to nearby residents, particularly those in the apartments directly above Flawd at 9 Keepers Quay. They also cited previous complaints about music disturbance and the management of the outside area. However, the report pack states that the Licensing and Out of Hours Compliance Team withdrew their objection after the applicant agreed to additional conditions, including:
- Displaying notices on all outside tables and benches requesting customers to be respectful of local residents and keep noise to a minimum.
- Between 9pm and 11pm, staff will check the outside seating area for noise disturbance on an hourly basis, engaging with customers causing a disturbance and documenting these checks.
- Staff will regularly check the outside seating area to ensure customers do not leave with drinks, engaging with customers who do so and documenting these checks.
Some residents are opposed to the variation, raising concerns about increased noise, cigarette fumes, customers loitering late at night, and increased litter. Other residents support the variation, stating that they view Flawd as a local amenity, enjoy living in a mixed-use area, feel more secure with the premises nearby, and support the hospitality industry.
The report pack also refers to Manchester City Council's Statement of Licensing Policy 2024-29, in particular the area-based policies for Ancoats and New Islington, which aim to:
- Maintain the balanced development of the area, while avoiding concentrations of alcohol-led venues
- Ensure waste-management bins are properly presented for collection
- Promote twilight transition into the evening economy and promote dining and cultural uses
- Deter antisocial street drinking in public places.
The report pack states that the panel should consider that the special policy for pubs, clubs and bars in this area is that for the night-time economy1 licensable activities will generally be permitted until 11pm (Sunday to Thursday) and midnight (Friday and Saturday).
Burger Box, 479 Cheetham Hill Road - Application to Vary a Premises Licence
The panel will also consider an application to vary a premises licence for Burger Box, located at 479 Cheetham Hill Road, Manchester, M8 9LR.
The applicant, Abdul Manan Ahmadzai, is seeking to:
- Extend the permitted premises operating hours and licensed hours for the provision of late-night refreshment2 until 3am the following day, Sunday to Thursday.
- Remove conditions 3, 4, 6, 7, 10, 11 and 12 from Annex 2 of the Premises Licence and replace them with new conditions proposed via the application.
The report pack indicates that one representation was received from the Licensing and Out of Hours Compliance Team, objecting to the application on the grounds of the licensing objectives relating to the protection of children from harm, the upholding of public safety and the prevention of public nuisance.
The Licensing and Out of Hours Compliance Team is concerned that extending the premises' operating timings to 3am in a primarily residential area could lead to increased incidents of public nuisance and antisocial behaviour. They also believe that permitting the premises to operate until 3am could set a precedent that could encourage other licensed premises in the local area to follow suit.
The Licensing and Out of Hours Compliance Team also object to the application to remove the stated conditions, as it is perceived that by removing those conditions it would mean that the premises would no longer be compliant with the four licensing objectives.
The Licensing and Out of Hours Compliance Team have indicated that they would be in agreement to withdraw their objection if the applicant agreed to reduce the applied-for extension to the premises operating and Late Night Refreshment timings to 2am and to retain the conditions that have been applied for removal.
The report pack refers to the council's licensable activity special policy LASP3, which relates to delivery services for alcohol and late-night refreshment, stating that when considering applications for delivery services, the licensing authority will consider how the applicant will ensure that this service is not likely to adversely impact on the licensing objectives.
Casa Mia, 29 Shudehill - Temporary Event Notice
The panel will consider a temporary event notice (TEN) 3 which has received an objection notice for Casa Mia, 29 Shudehill, Manchester, M4 2AF.
The premises user, Abolfazl Samizadeh, has applied for a TEN to extend operating and licensable activity timings for a Halloween party and birthday party, between 11pm and 4.30am on 31 October, 1 November and 2 November 2025.
The report pack states that an objection notice was received from the Licensing and Out of Hours Compliance Team, who have concerns that granting the TEN in its current form could lead to issues of public nuisance and public safety due to a lack of conditions proposed by the applicant.
The Licensing and Out of Hours team recommend that the TEN be granted with a condition that the premises adhere to the conditions on their premises licence for the duration that the TEN is valid.
