Affordable Housing Delivery Supplementary Planning Document

Following consultation on the draft Affordable Housing Delivery Supplementary Planning Document (SPD) earlier this year, this report provides feedback on the responses to the consultation, outlines changes to be made to the SPD and recommends adoption of the SPD.

Confirmation of Article 4 Direction – removal of permitted development rights to change of use from Class E (commercial class) to C3 (residential)

The report recommends that the Cabinet approves the confirmation of an Article 4 Direction to remove the permitted development rights to change use from Class E (commercial, business or service) to C3 (residential) on protected employment sites within the Borough following public consultation. The Council made a non-immediate Article 4 direction on 18th January 2024, as agreed by Cabinet on 13 December 2023 (Agenda item 12 Minute refers), that would remove certain permitted development rights that would result in new residential dwellings covering protected employment sites set out in BLP Policy ED2. Subject to the Council confirming the direction, and there being no intervention by the Secretary of State, it would come into force on 30 January 2025. This report recommends confirming the direction.
