Decision

The Adur Cabinet Member for Environment and Leisure abstained from the decision as it was predominantly a Worthing matter.

The Worthing Cabinet Member for Culture & Leisure approved the following:

That the Director for Place be authorised to execute the Settlement agreement (set out in the exempt Appendix to this report) to resolve outstanding issues under the JCT Design and Build Contract between Worthing Borough Council and Morgan Sindall.

Reasons for the decision

This is a long standing dispute that has been resolved with an improved ground source heat pump that will reduce the carbon use of the facility plus the cost of energy. The resolution of damp in the data/comms room is also part of this agreement.

Alternative options considered

A lower specification ground source heat pumpwould not have had the same benefits in carbon and cost reduction.
