Decision

WBC Cabinet Member for Finance & Resources:

I am happy to abstain from this decision as it is essentially an Adur matter.

ADC Cabinet Member for Finance & Resources:

I approve a reduction of £90,000 from the planned contribution to the Property Risk Reserve to meet costs associated with the effects of the tenant’s administration (including any associated release of NCP’s subsisting liabilities negotiated as part of the surrender referred to in paragraph below) and keeping the Car Park open for use by other Adur District Council tenants funded to the amount set out in the Exempt Appendix.

I delegate authority to the Service Director, Place & Economy, in consultation with the Cabinet Member for Finance and Resources to, continue to negotiate the terms of a surrender of the Car Park Lease (which may include an agreement in relation to the release of NCP’s subsisting liabilities under the Car Park Lease) and to enter into and execute any necessary legal documentation to implement the surrender of the Car Park Lease on the terms agreed.

I note that, subject to Adur District Council taking back possession of the Car Park, the next steps will be to either: Manage the Car Park by way of a service level agreement with a service provider for a period then tender and grant a commercial lease; and/or directly tender and grant a commercial lease of the Car Park; under the Service Director, Place & Economy’s delegation within the Adur District Council’s Scheme of Delegations.

Any further governance arrangements arising from these next steps will be in consultation with the Cabinet Members and compliant with the Council’s constitution

and decision making arrangements.

WBC Cabinet Member for Finance & Resources: I am happy to abstain from this decision as it is essentially an Adur matter.

ADC Cabinet Member for Finance & Resources: I have been kept fully informed by the team since the tenant NCP vacated the premises. I am comfortable that the appropriate steps are being taken to secure a permanent tenant whilst being managed in the interim.

ADC Cabinet Member for Finance & Resources:  We have considered the very limited  alternative options available to us and the proposed course is the most pragmatic solution at this time.
