Decision

Minute 581 Environment Committee January 2022 Delegated Authority be given to the Group Head of Technical Services or their nominated representative to make any necessary consequential changes to the attached Enforcement Policy for Environmental Health, Private Sector Housing, Licensing and Cleansing and the Statement of Principles for the Electrical Safety Standards in the Private Rented Sector Regulations 2020 and the Smoke and Carbon Monoxide Alarm Regulations 2015, as a result of new legislation or alternative practices.

The decision taken was to agree an amendment to the existing joint enforcement policy for Environmental Health, Private Sector Housing, Licensing and Cleansing.

Reasons for the decision

Full Council agreed at their meeting on 16 July 2025 that the Enforcement Review Panel was to be disbanded from 1 September 2025. Therefore the policy requires amendment to reflect this change and substitute with a new process for making decisions to prosecute.


Alternative options considered

To not make amendments to the existing policy, this would leave the Council open to challenge in regard to any decisions to prosecute as there would not be an agreed process in place.
