Decision
To instruct legal to review all of the associated documentation to include recent correspondence. The outcome of which to be issuing a letter before action demanding the arrears are paid within 10 working days.
Failed payment of the arrears following the letter before action will inevitably lead to ADC having to pursue forfeiture via peaceable re-entry and complete withdrawal of the tenant’s rent deposit of £2,500.
Reasons for the decision
The property forms part of the commercial investment portfolio. The tenant has accrued rent arears of £24,000 and the premises is also not currently being operated.
The last rent payment received was in July 2024.
The level of debt now stands as one of ADC’s highest debtors.
Informal approaches have not resulted in payment of the rent arears.
Taking possession will provide the Council with the opportunity to re-let the premises and generate income and stop any further arrears accruing.
