Decision
Instruct Legal Services to forfeit the lease.
Reasons for the decision
The lease has come to an end following the death of the leaseholder and it has not been possible to progress transfer of the lease. Legal advice has been obtained regarding the available options for bringing the lease to an end and enabling the beach hut to be re-let. Under the terms of the lease, forfeiture may be effected where rent remains unpaid for more than 21 days. The annual rent has remained outstanding since 1 April 2026.
Forfeiture is the quickest and simplest action to end the lease and permit the beach hut to be re-let.
Alternative options considered
Alternative methods of ending the lease were considered but were likely to result in delay before the beach hut could be returned to the Council and re-let.
