To serve a Notice to Quit on the tenant, Ms xx, to end the tenancy and recover possession of the property.

Reasons for the decision

It has been established that the tenant has vacated the property and is now residing in the Dorset area. The property is no longer being occupied as the tenant’s only or principal home and there is no indication of an intention to return.

Under the terms of the tenancy agreement, occupation as the main home is required. As this condition is no longer met, the Council is entitled to serve a Notice to Quit to end the tenancy

Alternative options considered

Alternative options were not appropriate in this case. The tenant is no longer residing at the property, and engagement to regularise the situation has not been evidenced. Serving a Notice to Quit is the appropriate and necessary action in line with the tenancy agreement.
