Decision
To instruct Legal Services to prepare and execute all documentation in relation to a lease of the Kiosk for a term of two years to Cookoo Bakes for the selling of homemade cakes and drinks throughout the summer season.
Reasons for the decision
The previous tenant passed away just prior to their lease expiring. As the family own the kiosk they approached us to see if they could re-purpose the kiosk. This was discussed between P&E Manager and Head of Service and agreed.
The kiosk is the property of the XXXX XXXX and the owner of Cookoo Bakes, XXXX XXXX is a family member. She owns an established bakery business in Chichester. It is her intention to renovate the kiosk in keeping with the existing requirements and affix signage for her bakery business. We have been provided with various documentation including a Level 3 Hygiene and Safety (Supervisor) certificate.
The lease is to be contracted out of the LTA1954.
Annual rent to be £1500 per annum and a one-off contribution of £250 towards council’s legal fees.
Alternative options considered
Removal of the kiosk from site.
ADC to purchase the kiosk and market – an inspection was carried out but it was decided against due to the condition of the kiosk.
