To authorise the service of a Notice of Seeking Possession (NOSP) against xxx, tenant a property in Bognor Regis, PO21 xxx, due to substantial rent arrears and continued breach of tenancy obligations.

Reasons for the decision

The tenant has accrued rent arrears in excess of £10,000 and has a long-standing history of non-payment and arrears management interventions. Previous legal action resulted in a Suspended Possession Order requiring payment of the current rent together with an additional amount towards the arrears. The order was subsequently breached and recovery action recommenced. No payments have been received since April 2026 and there has been no engagement with letters, telephone calls or other contact attempts. There are no known vulnerabilities or circumstances identified that would prevent the tenant from meeting their tenancy obligations.

Alternative options considered

• Continue to pursue the arrears without formal legal action.
• Negotiate a repayment arrangement with the tenant.
• Delay legal action pending further contact attempts.

These options were considered but rejected due to the level of arrears, the tenant's lack of engagement and the previous failure to comply with repayment arrangements and court-ordered terms.
