To authorise the service of a Notice to Quit on xxx requiring possession of the temporary decant accommodation at xx Anderson Way, Littlehampton, BN17 xxx and requiring the occupant to vacate the property in accordance with the terms of the licence agreement.

Reasons for the decision

The occupant was provided with temporary decant accommodation whilst works were undertaken to their permanent home at xx Hastings Close, Bognor Regis, PO21 xxx. The permanent property was ready for reoccupation and, under the terms of the Decant Licence Agreement signed on 19 February 2026, the occupant was required to return to their permanent accommodation on completion of the works. The occupant subsequently advised that they were unwilling to return, leaving the council with no alternative but to serve a Notice to Quit in accordance with the licence agreement.

Alternative options considered

• Allow continued occupation of the temporary decant accommodation.
• Extend the temporary licence arrangement beyond the completion of the works.
• Seek an informal resolution without serving notice.

These options were considered but rejected as the purpose of the temporary accommodation had ended once the permanent property became available for reoccupation and the licence agreement required the occupant's return.
