Authority granted to proceed with eviction action against Miss xxx in respect of a property in Bognor Regis, following breach of a suspended possession order dated 17 April 2026

Reasons for the decision

The tenant has current rent arrears and court costs totalling £5,378.38 and has breached the terms of a suspended possession order requiring payment of the current rent plus £100 per month towards arrears. Despite support from housing staff, reminders regarding rent shortfalls and previous payment arrangements, the tenant has failed to maintain the required payments. The tenant also has former tenancy arrears of £2,823.11 being managed by Liberata, together with council tax debts. The approving manager determined that eviction action was justified based on the level of current and former arrears and the ongoing breach of the court order.

Alternative options considered

Alternative options including payment agreements, support from housing staff, budgeting and debt advice through Citizens Advice, and ongoing engagement regarding rent shortfalls were pursued. These measures did not resolve the arrears situation or prevent breach of the suspended possession order.
