Authority granted to proceed with eviction action against Mrs xxx and Mr xxx in respect of a property in Bognor Regis, following breach of a suspended possession order dated 22 May 2026.

Reasons for the decision

The tenants have current rent arrears and court costs totalling £7,673.92 and have breached the terms of a suspended possession order requiring payment of the current rent plus £200 per month towards arrears. Despite discussions regarding income and expenditure, payment arrangements and support offers, the arrears have continued to increase. The tenants receive income from a range of sources including pensions, employment, Universal Credit and Personal Independence Payment, but their income and savings are too high for full housing costs to be met. The approving manager noted the tenants’ income and savings position when reaching the decision to proceed with eviction.

Alternative options considered

Alternative options including payment agreements, financial inclusion support, discussions regarding income and expenditure and opportunities to clear or reduce the arrears were pursued. These measures did not result in compliance with the court order or a sustainable reduction in arrears.
