Decision

To appoint Capsticks Solicitors LLP to provide expert legal advice and assistance with drafting contractual and related legal documentation required to regularise key compliance contracts relating to housing and landlord services functions. The appointment will support the council in establishing compliant contractual arrangements and mitigating risks associated with expired contracts which have continued in operation.

Reasons for the decision

Specialist legal advice is required to support the regularisation of a number of key compliance contracts affecting critical housing services and tenant safety. External expertise is necessary to ensure the council's approach is legally robust and that appropriate contractual documentation is prepared. Capsticks Solicitors LLP has already provided specialist advice regarding the proposed approach to maintaining contractor engagement whilst longer term arrangements are established.

Alternative options considered

The use of the council's in-house legal team was considered. This option was rejected because the in-house legal team does not have sufficient capacity to provide the specialist support and document drafting required within the timescales necessary to regularise the contracts and protect service continuity.
