Decision

To withdraw the report entitled Regularising Key Contracts from the Housing and Wellbeing Committee agenda scheduled for 24 September 2026 and defer consideration of the matter to the 24 November 2026 meeting of the Housing and Wellbeing Committee.

Officers are continuing to work with Capsticks and the council's legal advisers to implement short term legal arrangements that maintain continuity of critical services whilst a longer term solution is developed and procurement activity is commenced.

Reasons for the decision

Since the report was prepared, the position regarding the regularisation of the heating and fire safety related contracts has continued to evolve. An Officer Decision relating to the immediate short term legal arrangements advised by Capsticks has been published and work is ongoing to implement those arrangements. The current letters of comfort expire on 23 September 2026 and discussions remain active regarding the most appropriate medium and longer term contractual and procurement solutions.

Given the fluid nature of the current situation, the report presented only a partial snapshot of the position at a specific point in time. Presenting the report to Committee at that stage would result in Members considering information that may shortly be overtaken by events, whilst we are working through the Committee processes. Deferral will allow officers to develop a more comprehensive and informed report for the Housing and Wellbeing Committee on 24 November 2026, when the longer term legal and procurement options are expected to be clearer and procurement activity will have commenced.

The November report will provide Members with the opportunity to scrutinise the proposed longer-term arrangements and procurement strategy based on a more complete and stable evidence base.

Alternative options considered

Proceed with the Committee report as originally drafted. Rejected because the information available at the time of writing is incomplete and subject to ongoing legal and commercial discussions.

To convene a Special Meeting of the Housing and Wellbeing Committee prior to November 2026. Rejected because the circumstances did not meet the constitutional threshold for urgency. The contractual position and the expiry of the relevant agreements were matters already known to the council and were not unforeseen events requiring an urgent committee meeting. Given that interim arrangements are being progressed through the appropriate officer decision-making route and legal advice from Capsticks, it was considered more appropriate for Members to consider the matter through the normal committee cycle once the longer term contractual and procurement options have been sufficiently developed. This will enable more effective Member scrutiny based on a fuller understanding of the available options and their implications.
