Decision

To approve and instruct legal services to prepare and complete a new 3 year business tenancy contracted-out of sections 24-28 of the Landlord & Tenant Act 1954 for the area on Bognor seafront known as Food on the Prom. Terms have been agreed with the tenant who is currently in occupation.

Reasons for the decision

The tenant is in occupation on an expired, unprotected lease. The new agreed rent shall be £8,500 up from £6,000. This is a departure from the kiosk policy in order to regularise the tenancy position.

Alternative options considered

Advertising the opportunity to the market - may be jeopardised by the existing tenant remaining in possession.
