Purpose

Approval is sought to consult on proposals based on identified
need, endorse the business case, and progress the development of a
new SEND school via the Free School Presumption route, including
provider appointment in line with DfE processes. This includes
allocating funds from the SEND capital grant, entering into a
lease, and establishing a sub-lease with the future education
provider.

Decision

RESOLVED
that Cabinet:-
 
(i)           
Gives approval to proceed with the establishment of
a strategic partnership arrangement with a local SEND school or
academy trust to enable the delivery of the 45 additional SEND
places as a satellite provision;

 
(ii)         
Approves the allocation of £2,284,905 in
2025/26 (including the previously agreed £385,000 enabling
works grant) and £681,670 in 2026/27 from the SEND capital
grant to undertake the required capital works; and
 
(iii)        
Approves the commencement of negotiations with HCAT
and the future education provider strategic partner to secure the
most appropriate lease arrangements. This will be subject to
negotiation and any necessary BMBC approvals/consents, any DfE
approvals/consents.
