Decision

The Deed of Postponement provides for the Council's equitable district heating charge contained within clauses 6(1)(a) and (b) of the Conveyance dated 15 April 1983 to be postponed in priority to a mortgage and further advance. The proposed arrangement does not remove the Council's charge but alters its priority ranking in favour of the lender, enabling the property owner to secure additional borrowing. The Council's interest remains protected, and there are no grounds to withhold consent. Accordingly, it is considered reasonable and appropriate to enter into the Deed of Postponement.
