Purpose

A TRO, 26-052A Royal Victoria Park, Bath, has been made in accordance with The Traffic Regulation Order (TRO) process in England and Wales which is governed primarily by the Road Traffic Regulation Act 1984 (RTRA 1984) and the Local Authorities' Traffic Orders (Procedure) (England and Wales) Regulations 1996.

After the TRO was sealed, it was brought to the attention of the Council that a lengthy document objecting to the TRO was not taken into consideration due to a technical and administrative oversight and therefore was not placed before the decision maker.

Decision

The Director of Place Management has revoked the previous decision to be able to formally review the missed objection together with all previous objections, thus allowing the decision maker to make a fresh decision. Option (2) cited in this notice provides a sound basis for rectifying the technical and administrative oversight whilst taking into account the public purse. It allows for the consideration of the missed objection together with all other previous objections submitted, whilst saving the time and costs of starting the process from the outset. If the decision remains to make the TRO, this option protects the timeline for implementation.

Alternative options considered

The Council has a number of options to address this issue which are outlined below:
Option 1 - Consider the matter closed as the thematics of the report which have already been considered are sufficient to take account of the issues within the missed objection document.
Option 2 - Revoke the previous decision and formally review the missed objection together with all previous objections, thus allowing the decision maker to make a fresh decision.
Option 3 -Start the TRO process from the beginning.
