RESOLVED
 

(1)  
That the Darwen Resource Centre’s recommendation for service
relocation and disposal following a review of Council assets in
2023/24 approved by Finance Council in February 2024 be noted.

 

(2)  
That the proposed purchaser be designated as a ‘Special
Purchaser’ under the Council’s Disposal Policy
primarily due to its proximity and clear connections to the sale
site.
 

(3)  
That the disposal of Darwen Resource Centre at Special Purchaser
Value in accordance with the Councils Disposal Policy be
approved.
 

(4)  
That it be noted the land was construed as open space in character
therefore such appropriation must also comply with S122(2a) of the
Local Government Act 1972 and hence the Deputy Director of Legal
and Governance be authorised to advertise the proposal to
appropriate accordingly.
 

(5)  
That the Deputy Director of Legal and Governance be authorised to
advertise the proposal to dispose of ‘open space’ in
accordance with the statutory process under Section 123(2A) of the
Local Government Act 1972.
 

(6)  
That the Executive Member of Growth and Development be authorised
to consider any objections to both the appropriation proposal and
‘open space’ disposal.
 

(7)  
That the Strategic Director of Growth and Development be authorised
in liaison with the Deputy Director of Legal and Governance to
finalise the terms and any costs in connection with the
disposal.
 

(8)  
That pursuant to the officer delegated powers, the Chief Executive
shall make arrangements to change the polling station for Darwen
East 2 (DE 2) polling district to another suitable venue pending
the next formal review.
