Resolved –

The Panel noted, following the helpful submissions received, that further checks had been undertaken regarding the location of the land to which the application related. Having reviewed the matter, it was established that the field was situated wholly within the Kirklees local authority area.

The Panel acknowledged that the Licensing Act 2003 makes provision for a licensing authority to determine applications that span more than one local authority area. However, that provision did not apply in this case, as the field subject to the application lay entirely within Kirklees.

The Panel expressed its sincere apologies for the oversight. In the circumstances, it was resolved that Bradford Council had no jurisdiction to determine the application and, therefore, could not consider it further.
