Decision

Resolved-

Having considered all valid representations made by the parties at the hearing, the valid written representations received during the statutory consultation period, the Council’s published Statement of Licensing Policy, the Licensing Act 2003, in particular section 42 concerning an application to transfer a premises licence, and the relevant statutory guidance issued under section 182 of the Licensing Act 2003, the Panel was satisfied that granting the application to transfer the premises licence would undermine the licensing objectives, in particular the prevention of crime and disorder.

Reasons:

  1. 1.    Members carefully considered the representations and evidence before them, including the history of criminal offending.
  2. 2.    In the view of the Panel, the available evidence provided insufficient assurance that the criminal offending would not be repeated. The Panel therefore had no confidence that there would not be a recurrence of such offending.
  3. 3.    The Panel found that the risk of recurrence, and the consequent risk of undermining the prevention of crime and disorder licensing objective, was such that it would be inappropriate to grant the application to transfer the premises licence under section 42 of the Licensing Act 2003.

For these reasons, the Licensing Panel refused the application to transfer the premises licence.
