Purpose

To approve the new Enforcement Policy and Civil Penalty Policy

Decision

RESOLVED that:

1)    Cabinet approves the immediate implementation of new Enforcement Policy and Civil Penalty Policy, to take immediate effect, with transitional arrangements allowing the existing policies to operate in tandem for a limited period to conclude legacy cases. 

Reasons for the decision

Option 1 is recommended. It provides the most robust, legally compliant, and consistent approach to enforcement under the Renters’ Rights Act, while allowing for managed transition and alignment with national best practice.

Alternative options considered

1)    Approve the new Enforcement Policy and Civil Penalty Policy, to take immediate effect, with transitional arrangements allowing the existing policies to operate in tandem for a limited period to conclude legacy cases. 

2)    Do nothing.
