Purpose

On 6 February 2024, Cabinet authorised the
Executive Director of Growth and Regeneration in consultation with
the Cabinet Member for Transport to take all steps required to
procure and award a Highways Defect Response and Emergency Works
contract to replace the existing contract ending in August
2025.
The purpose of the report is to seek approval for the award of a
new Highways Defect Response and Emergency Works Contract following
a competitive open tender process. This contract is essential in
supporting the Council’s statutory duty to keep the local
Highway network in a safe and usable condition. The scope of this
contract consists of, but is not limited to fixing potholes,
footway repairs, repairing and replacing kerbs and channels,
adjusting iron works and removing obstructions from the
highway.

Content

An 8-year contract, with 2 optional 2-year
extensions, has been awarded to ETM Contractors Ltd.

Alternative options considered

Option 1 - Alternative procurement options
were considered as part of the procurement of the Gully Cleansing
and Subway Drainage Term Maintenance contract, Defects Response and
Emergency Works Term Maintenance contract and Highways Asset
Management and Civils Framework. The options considered were a
direct labour organisation (DLO) or using a single supplier across
all contracts. Following best practice and evidence of
cost-effective delivery and performance, a separate Framework with
multiple Lots and providers, alongside dedicated Term Maintenance
contracts was preferred.
