The Portfolio Holder for Public Protection and
Enforcement approved the Public Protection Enforcement Policy,
including the additional powers for a new statutory provision that
banned the sale and supply of single-use vapes and plastics in
England.

Reasons for the decision

Approval was required to update
the Public Protection Enforcement Policy to incorporate new Trading
Standards powers to implement civil sanctions as part of their
enforcement toolkit for breaches related to these new powers.
This specifically targets breaches
of consumer protection legislation concerning single-use vapes and
single-use plastics.
This new statutory provision was
made under the Environmental Protection Act 1990 and the Regulatory
Enforcement and Sanctions Act 2008. The specific statutory
instrument which uses the powers granted under RESA 2008 is the
Environmental Protection (Single Use Vapes) (England) Regulations
2024. 
It came into force on 1st June 2025
and bans the sale and supply of single-use vapes and plastics in
England
