Purpose

This report requests the Director of
Environment & Sustainability, following  consultation with the Director of Economy,
Regeneration and Investment, to approve  entering into an agreement to exchange highway
land shown coloured orange (1.65 Square metres) for the land
coloured pink (3.49 Square metres) on the plan at Appendix 4
surrounding the property at 237-247 Tottenham Court Road, 3 Bayley
Street and 1-4 Morwell Street for the purposes of adjusting the
highways boundary.

The Director of Environment &
Sustainability, following consultation with the Director of
Economy, Regeneration and Investment, is asked to:
 

I.           
Note the report and the Highway
Authority’s comments.

II.           
Approve the advertising of notice
under Section 256 (S256) of the Highways Act 1980 of the proposal
to enter into an agreement to swap the highway land shown coloured
orange in exchange for the land, coloured pink on the plan at
Appendix 4 subsequently adjusting the highway boundary.

III.           
Subject to no appeal being lodged
at the magistrates court, to approve the entering into of the
proposed agreement for the exchange of land to adjust the highway
boundary;

IV.           
Should an appeal be lodged at the
magistrate court, which is dismissed, to delegate authority to
consider any objection to the proposed exchange of land, and
whether to proceed, to the Chief Engineer.
