Purpose
This report seeks Director authorisation to enter
into a Highways Agreement under s38 and s278 of the Highways Act
1980 in accordance with the Councils scheme of delegation. It
provides the background to the accompanying agreement to enable the
delivery of a canal bridge between Camley Street and
the “Tribeca” development on St Pancras Way (aka
“Ugly Brown Building”).
The agreement is required to satisfy contractual s106 planning
obligations entered into in March 2020 and April 2023 setting out
provisions under which the developer of the Tribeca scheme (Reef
Group) oversees and procures the design and construction of a
bridge and the Council collaborates on its delivery through the
design and approval processes (including related technical
approvals). The bridge was granted planning permission in June 2022
and the Highways Agreement sets out further provisions that,
subject to the bridge being constructed and completed to the
requisite standards, the Council will adopt and maintain the bridge
as public highway. As the project involves a section of the
Regent’s Canal and related “airspace” the Canal
& River Trust (CRT) are also a party to the agreement.
Simultaneously a separate lease agreement between the CRT and
the developer to grant rights to build over the canal is also being
finalised and will be subject to final consent by the Department
for Environment, Food and Rural Affairs.

outlined in paragraphs 1.4 and 8.2.
