Purpose
This report sets out the commissioning strategy for Floating and
Community Support for Adults with Learning Disabilities. The
current contract with Centre 404 ends on 30th June 2024 with no
option to extend further. The approach proposed will ensure the
Council meets its legal duty to people with learning disabilities
with Care Act eligible needs, offer service continuity and allow
sufficient lead-in time for officers to recommission a new service
to commence on 1st April 2025.
In accordance with Contract Standing Order 3.4, the Executive
Director, Adults and Health in consultation with the Cabinet Member
for Health Wellbeing and Adult Social Care must agree the
commissioning strategy. In order to negotiate a new contract with
Centre 404 a waiver of Contract Standing Order C3.1 (obligation to
carry out a competitive tendering process) is required. Given the
value of the proposed contract this must be agreed by the Executive
Director Corporate Services with approval from the Cabinet Member
for Health, Wellbeing and Adult Social Care. A separate report was
submitted to the Cabinet Member for Health, Wellbeing and Adult
Social Care (Appendix 2).
This report includes a Part II appendix which contains
commercially sensitive information relating to Centre 404.

That the Executive
Director, Adults and Health in consultation with the Cabinet Member
for Health, Wellbeing and Adult Social Care
approves the procurement strategy for
Floating and Community Support for Adults with Learning
Disabilities, which includes a contract term of nine
months commencing on 1st July 2024 for an estimated
value of £1,416,548 (submitted to decision maker on 29
February 2024)
That the Executive
Director, Adults and Health grants a waiver of
Contract Standing Order C3.1 in order to put in place
a new contract with Centre 404 from 1st July 2024,
subject to agreement by the Executive Director Corporate Services
and approval by the Cabinet Member for Health, Wellbeing and Adult
Social Care (in line with Contract Standing Order F3.4)
(submitted to decision maker on 11 March 2024)
That the Executive
Director Corporate Services agrees to waive the
requirement for a competitive process further to Recommendations 1
and 2 (submitted to decision maker on 11 March 2024) and
subject to approval by the Cabinet Member for Health, Wellbeing and
Adult Social Care (Appendix 2).
