Purpose

This report seeks approval of the appropriation for planning
purposes of land held by the Council for housing purposes in order
to facilitate the regeneration of Tybalds estate.
 
 

Content

That the Executive Director Supporting Communities, in
consultation with the Cabinet Member for New Homes, Jobs and
Community Investment, the Executive Director Corporate Services and
the Borough Solicitor:
 
1.       approves the
appropriation of the land and buildings as shown edged red on the
plan at Appendix A which is no longer required for the purpose for
which it is held, from housing purposes to planning purposes under
section 122 of the Local Government Act 1972 to facilitate the
redevelopment of the land in accordance with planning permission,
subject to obtaining the Secretary of State’s consent under
section 19 of the Housing Act 1985.
 
2.       Pursuant to
section 232 of the Town and Country Planning Act 1990, approves the
subsequent appropriation of the same land to the
Council’s
Housing Purposes, where necessary, pursuant to sections 9 and 19
of the Housing Act 1985 for the purposes of the delivery of the
redevelopment.
