Purpose
This report is coming to the Director of Development and Corporate Property to seek approval to extend the contract for Philip Pank Partnership (PPP) for the provision of Employer’s Agent, Site Inspector and Cost Consultant services on the Bacton Phase 2 development scheme.
The original appointment was made in 2016 when the Council intended to deliver the scheme through direct delivery. The contract was subsequently amended in September 2022 when the decision to switch to a Development Agreement (DA) approach was approved by Cabinet (SC/2022/44). Mount Anvil (MA) are the developer partner with whom the Council entered into a DA in April 2024.
Throughout their appointment PPP have provided comprehensive Employer’s Agent and Cost Consultant support to the Council. This has been invaluable given the commercial nature of working within a DA and the Development Partner as gatekeeper of the design and construction programme. An extension to PPP’s contract is sought in order to maintain sufficient scrutiny of all DA related matters and ensure the Council’s interests are protected throughout the delivery of this major regeneration project with an anticipated 468 homes of which 40% will be affordable across Phase 1 and 2 on floorspace.
Approval is therefore sought for a variation to increase the contract sum by £444,795 to cover the remainder of the programme, currently estimated to cover 125 months from the October 2022 appointment, taking the appointment up to May 2033.

Decision
(i) THAT the variation of the Contract entitled “Consultancy Agreement Between the London Borough of Camden and Philip Pank Partnership for Services at Bacton Low Rise – Phases 2 & 3” to include an extension of services in line with the pricing schedule set out in Appendix A to a revised value of £744,645 (an increase of £444,795) be approved; and
(ii) THAT the option to further vary the contract should the delivery programme be extended under the terms of the signed Development Agreement (including any subsequent variation if applicable), and the Consultant's scope of work remains applicable and unchanged, be approved.
