Purpose
This report asks the Borough
Solicitor to use their delegated powers under to Constitution to
authorise the commencement of legal proceedings.
Under the Council’s
Constitution, the Borough Solicitor is authorised to
‘Institute, defend or participate in any legal proceedings or
impose a financial penalty as an alternative to legal proceedings
in any case where such action is necessary to give effect to a
decision of the Council or otherwise the Borough Solicitor consider
such action to be in the Council’s best
interests.’
It is recommended that it is in
the Council’s best interests to protect its position by
ensuring a claim is lodged within the limitation period.
