Decision
- The proposed amendments be approved to reflect the national scheme of delegation for planning functions which is to be added to the Constitution once the legislation takes effect; And in?addition?that:??
Council consider whether, before the final wording is incorporated into the Constitution on 31 October, the Leader of the Council should write to the Minister?requesting?that the draft national scheme of delegation be reviewed again, and further clarification provided, before final adoption. It was noted that any response received from the Minister could be?taken into account?when formulating the Council’s guidance. However, in the absence of a response, implementation of the Regulations would still be required by 31 October.?

- The following delegation is added for the Director of People: To enter premises and to exercise all the Council’s statutory powers and duties in relation to private rented sector regulation and enforcement under the Housing Act 1988, the Renters’ Rights Act 2025, and any regulations or subordinate legislation made under those Acts.?

- The duties and responsibilities of the Leader be added to Part 6 of the Constitution, as described in the report.?

- The following delegations to the Joint Chief Executives be added to support the council’s response to Local Government Reorganisation -??
- To take such steps, and to provide such information, responses, submissions, assurances and supporting material to any Government?department, Minister, Senior Responsible Officer (or other post as set out in any Structural Changes Order) or other public authority as the Joint Chief Executives consider necessary or expedient in connection with Local Government Reorganisation,?subject to consultation with the Leader where?appropriate?or?required.??

- To authorise the extension of contracts and partnership agreements beyond vesting day of the creation of the new unitary authority, where necessary and in compliance with procurement rules and the council’s contract standing orders.?

- The Monitoring Officer be authorised to make any consequential or minor drafting changes required to give full effect to these recommendations.?
