Purpose

To provide an update on Cheshire East Council's work to address excessive vehicle noise and associated anti-social behaviour (ASB), outline progress made to date, and set out the proposed next steps to enable implementation of a borough-wide acoustic camera enforcement approach.

Decision

That the implementation of a new Borough-Wide PSPO relating to Excessive Vehicle Noise and Anti-Social Driving be approved.

Reasons for the decision

Complaints relating to excessive vehicle noise and anti-social driving continue to be received from communities across the borough and regular incidents reports are now being received from Cheshire Police.

A borough-wide approach provides a consistent and proportionate framework for enforcement and reduces the risk of anti-social behaviour being displaced between locations.

The PSPO will support the Council and Cheshire Police in addressing behaviours which adversely affect residents' quality of life.

The proposal aligns with the Council's commitment to creating safer communities and improving residents' wellbeing.

The consultation exercise has provided communities and stakeholders with an opportunity to comment on the proposals, and the responses received have been considered in developing the proposed Order.

Alternative options considered

Other Options Considered

Option

Impact

Risk

Do nothing

Current arrangements remain in place. The Council would continue to rely on existing powers and reactive enforcement activity.

Ongoing complaints from residents, continued community impact and limited ability to address issues proactively.

Introduce localised PSPOs in hotspot locations

Would provide enforcement powers at known locations.

Risk of activity moving to alternative locations and creating new hotspots elsewhere in the borough.

Introduce a borough-wide PSPO (recommended option)

Creates a consistent enforcement framework across Cheshire East and supports future deployment of acoustic camera technology.

Requires implementation and enforcement resources and completion of the statutory process.
