*RESOLVED –
1.
That the outcome of the consultation
undertaken on the new proposed Public Spaces Protection Order
relating to alcohol consumption, begging, car related anti-social
behaviour and other associated issues be noted.
2.
That the proposed Public Space
Protection Order, as shown in Appendix 1 of the officer’s
report, be agreed and implemented with effect from 16 July 2024 for
a period of three years.
REASONS FOR RECOMMENDATIONS
1.
There is clear evidence that the area
covered by the proposed public space protection order has been
subjected to consistent anti-social behaviour issues. The data
recorded between 1st February 2023 and 31st
March 2024 indicated that there were 711 incidents within the
proposedarea ofthe PSPOand ofthese 309were recordedas being relevant to
the PSPO controls, including anti-social behaviour (ASB), street
drinking, begging and car related ASB.
2.
PSPO’s are designed to ensure
the law-abiding majority can use and enjoy public spaces, safe from
anti-social behaviour, based on reasonable grounds that activities
carried out or likely to be carried out

Have had or are likely to have a
detrimental effect on the quality of life of those in the
locality
·
Is, or likely to be of a persistent or continuing in
nature
·
Is, or is likely to be unreasonable
·
Justifies the restrictions imposed
3.
Breaching a PSPO is a criminal
offence. Orders can be enforced by an officer authorised by the
local authority (including police community support officers) and a
police constable.
4.
The PSPO can be in place for a
maximum of three years and is designed to be flexible and
responsive to need. There is no limit on the number of times that
Orders can be renewed, as long as the need is still present.
Variation of a PSPO can be done at any timeto respondto thechanging
needs basedon evidenceof the effects on the quality of life of
those in the locality.
5.
The implementation of the new Public
Space Protection Order will provide council enforcement officers
and the Police appropriate and effective powers to manage and
reduce these issues and therefore improve community safety in the
local communities.
