The Sub-Committee consists of three Members of the Miscellaneous Licensing Committee (chosen on an alphabetical rotational basis) and considers at short notice the potential suspension/revocation of taxi driver/operator licences.   Urgent Driver/Operator/Vehicle Licence Sub Committee Terms of Reference   1.  Introduction This document sets out the terms of reference for the Urgent Driver/Operator/ Vehicle Licence Sub Committee. The Urgent Driver/Operator/Vehicle Licence Sub Committee is a Sub Committee of the Miscellaneous Licensing Committee. The Sub Committee’s remit is to consider the urgent review of the following types of licence:- ·  Hackney Carriage Drivers /Private Hire Drivers ·  Private Hire Operators ·  Hackney Carriage vehicles ·  Private Hire vehicles   The above licences are referred to as ‘driver, operator or vehicle licences’ throughout this document. Sub Committee hearings will be held when there are driver, operator or vehicle licences which need reviewing, which are urgent and cannot wait until the next scheduled Miscellaneous Licensing Committee.   2.  Role of the Sub Committee The role of the Sub Committee is to consider at short notice the potential suspension/revocation of driver, operator or vehicle licences.   3.  Appointment of members of the Urgent Driver/Operator/Vehicle Licensing Sub Committee The Sub Committee consists of three Members of the Miscellaneous Licensing Committee (chosen on an alphabetical rotational basis) and considers at short notice the potential suspension or revocation of driver, operator or vehicle licences.   4.  Quorum The Sub Committee shall have a quorum of 3 Members of the Miscellaneous Licensing Committee who must be present in person.   5.  Conflicts of Interest A policy for identifying and dealing with conflicts of interest for the LPB shall be set out in a separate policy document, but may form part of the Code of Conduct for the LPB.   6.  Knowledge and Skills The Sub Committee Members must have undertaken the mandatory Miscellaneous Licensing Committee training.   7.  Meetings The Sub Committee meetings will be held on an ad hoc basis as and when required.  The Sub Committee meetings will be emergency hearings held at short notice.  However, the licence holder will be made aware of the reason for the review of their licence, for example, the allegations or complaints made against the licence holder.  In addition, sufficient details will be provided to the licence holder to enable the licence holder to identify the complaints and the nature of the allegations prior to the hearing.  In accordance with the rules of natural justice, the licence holder will have the right to be heard before a decision is reached.   8.  Decision Making The decision of the Sub Committee will be made on the majority vote.
