This Decision Notice paper seeks permission to
procure and to delegate the subsequent permission to award to the
Director Place, Sustainable Growth and Transport  for a contract for the delivery of Surface
Treatment schemes within Cumberland Council (the Council). This is
a key decision to be made in accordance with the council
constitution. The contract will be for a maximum of 2 years with a
maximum spend of £4m

Reasons for the decision

Approving the permission to procure for the
provision of Surface Treatment through an open procedure ensures
that the Council is legally compliant with the Public Contracts
Regulations 2015 and will have a competent contractor to deliver
the Highways Surfacing Treatment schemes.
 

Alternative options considered

To not re-procure/no contract. This is not
considered appropriate as, due to the projected contract value,
this would mean non-compliance with the Contract Procedure Rules
and the Procurement Contracts Regulations 2015.
 
To procure each scheme individually. This is
not considered as appropriate due to losing economies of scale and
being able to achieve value for money for the Council. In addition
internal resource would be significantly increased as there would
be increased procurement and complexity.  In due course cumulative value of ad hoc
procurements would in a short time breach the Public Contracts
Regulations.
 
Delivery of the schemes by inhouse teams. This
is not considered an option due to the scale of work required.
