The Director – Place, Sustainable Growth
and Transport, in consultation with the Executive Member for
Sustainable, Resilient and Connected Places, is being asked to
approve permission to procure service contracts for the maintenance
and monitoring of the 35 Closed Landfill Sites for which Cumberland
Council and Westmorland & Furness Council (the Authorities)
have statutory responsibility.

Reasons for the decision

The recommendation to proceed with procurement
of one contract with Lot 1 for monitoring and maintenance of sites
in Cumberland, and Lot 2 for monitoring and maintenance of sites in
Westmorland and Furness.   This
proposal ensures that each maintains and monitors the sites in its
areas to manage the environmental risk. This also allows for an
eventual disaggregation of the landfill monitoring and maintenance
service.
 
From April 2024 for a period of three (3)
years.

Alternative options considered

Alternative options that have been considered
/ explored before the preferred option was identified, include:
 
Option 1 - Bring the service contract
“in-house” for each authority with a TUPE arrangement
for the technical skilled employees.  It
is not considered appropriate because of the additional
implications in relation to the hosted arrangements/inter authority
agreement.
 
Option 2 - Split the contracts into technical
monitoring and routine/non-routine maintenance for each
authority.  On analysis of the routine
and non-routine maintenance it is evident that this is of a very
technical nature e.g., replacement of boreholes and routine
maintenance is a relatively small part of the current contract
making it unattractive to potential bidders as a separate
contract.
 
Option 3  - Procure separate contracts for each
authority.  This would not provide best
value for each authority because it may result in different
contractors, which would not offer best value for the whole
service.
