DECISION
The sub-committee carefully
considered the application for a new premises licence which had
been made by 146 CM Group Limited in relation to Cheatmeals (of the
above address), as set out in the agenda pack. At the hearing,
verbal submissions were made in support of the application by Mr
Sami Akbary, owner of the business, by Mr Yasin Allam, head of
operations and by Miss Sarah Clover, barrister, King’s
Chambers.The sub-committee considered the
written and verbal representations in objection to the application
from Shane Elliot, Ealing Licensing Compliance Officer and Mimi
Stupu, Ealing Noise & Nuisance Team. There was also a written
representation from Ann Chapman, Chair of the Walpole Residents
Association, who was an interested party.
The licensing sub-committee
also considered the email dated 5 October 2023 from PC Vickie Hewison, West Area Ealing Police,
contained in the agenda pack, which contained the police’s
requested opening hours and hours for late night refreshment as
well as seven conditions to apply to the premises and to all
of which the premises had agreed.
The sub-committee took into account Ealing
Council’s Statement of Licensing Policy and the Home Office
Revised Guidance (December 2022) issued under S.182 of the
Licensing Act 2003.
Having considered all of the
above, the licensing sub-committee’s decision was to grant
the opening hours and the hours for late night refreshment (LNR) in
accordance with the police’s suggestions and subject to the
conditions requested by them, together with one additional
condition. The granted hours and conditions are given
below:

CONDITIONS
1. If the CCTV equipment is
inoperative or is otherwise not installed and working to the
satisfaction of the Police and Licensing Authority, the premises
must not be used for licensable activities unless with prior
agreement from the Police.
2. Training will be provided to
all staff as soon as practicable in relation to customer service
and conflict management and training records will be kept on the
premises for inspection by the Police or officer from the Licensing
Authority. Refresher training will take place every 6 months or as
soon as practicable.
3. Customers will be reminded
by way of a notice at the entrance/exit door to please leave the
premises quietly and have consideration for the neighbouring
properties.
4. No children unaccompanied to
be allowed on the premises after 23:00 hours.
5. Customers shall not consume
food or drinks on the premises after 00:00 hours Sunday to Thursday
and 01:00 hours on Friday & Saturday.
6. Best endeavours shall be
used to ensure that deliveries and collections are dealt with
expeditiously and that there is minimal waiting by delivery drivers
or customers collecting.
7. An incident log must be kept
at the premises, and made available on request to an authorised
officer of the Council or the Police, which must record the
following:
· all crimes reported to
the venue
· any complaints
received
· any incidents of
disorder
· any faults in the CCTV
system or searching equipment or scanning equipment
· any visit by a
relevant authority or emergency service
ADDITIONAL
CONDITION imposed by the licensing
sub-committee:
8. There should be a name and
phone number for a responsible individual in charge who can be
contacted by residents, the police and responsible authorities
displayed on the premises at all times and circulated to
neighbouring residents. This should be done as soon as
possible.
The above conditions are in
addition to those offered by the applicant in the operating
schedule part of their application.
