Purpose

To seek approval to enter into a Code
Agreement with Cornerstone Telecommunications Infrastructure Ltd
(the Operator). The Code Agreement shall allow access for
installation of a telecoms mast and associated apparatus at
Frederick Avenue Car Park.

Decision

It is recommended that the Leader of the
Council:
1.Approves the Council entering into a Code Agreement for the
siting of a telecoms mast at Frederick Avenue Car Park
2.Approves the Outline Terms at Appendix 1.
3.Delegates authority to the Property Services Manager (in
consultation with the Director of Operations) and Legal Services to
negotiate and approve the form of the final agreement.

Reasons for the decision

The acceptance of the agreement whilst
removing 3 spaces will increase total income without a significant
drop in parking provision.
Acceptance will prevent further notices or any appeals to the Upper
Tribunal at the detriment of the Council.

Alternative options considered

An alternative would be to not agree to enter
into the Code Agreement. However, this is likely to lead to the
imposition of Terms via the Upper Tribunal which could carry
reputational and financial implications.
