Reasons for the decision

Agreement to the S104 is required in order for the development to proceed, there is no Legal objection to the agreement so should be allowed to proceed on that basis.

Alternative options considered

An alternative would be to not enter into the agreement. However, Legal Services have confirmed they are happy to proceed and would have no objections so it would potentially be unreasonable not to proceed.
