The Overbridge Agreement dated 22 June 2023
was entered into by Network Rail Infrastructure Limited, Surrey
County Council and Guildford Borough Council, to enable Ash Road
Bridge (now to be called Chester Bridge) to be designed,
constructed and maintained over the railway line.
Clause 7.1.2 of that agreement stated that on Substantial
Completion (being when the Provisional Certificate is issued for
the road bridge) the parties agreed to enter into a deed of
easement, which was annexed to the Overbridge Agreement in agreed
form. This is that deed of easement, which is being executed in
readiness for the Provisional Certificate which is expected to be
issued shortly. This deed of easement includes dedication by
Network Rail as highway of the airspace above the railway where the
bridge is located and the grant by Network Rail to the Council and
Surrey County Council of rights to enable them to maintain the
bridge.
