Freehold transfer of two small pieces of land
on the north and south sides of Jacobs Well Road, Worplesdon,
between 1) Surrey County Council (SCC) and 2) GBC.
The transfer is essentially tidying up Title matters from when the
rest of the land was historically transferred between the
Parties.
The Council has agreed to make a payment of £10,000 plus
legal costs to SCC to compensate for the Officer involvement
required to resolve this matter. It is not a consideration for the
value of the land, which is land locked with no access from the
highway.
The transfer includes the following covenants;
GBC shall not use the property other than as a publicly accessible
open land and Nature Reserve to facilitate suitable alternative
natural greenspace (SANG) or grazing land.
GBC to provide an indemnity to SCC;
•to observe and perform the charges, incumbrances, covenants,
restriction and other matters in the Property and Charges Register
of HM Land Registry’s register of Title Number, and
•will keep SCC indemnified against all liability, proceedings,
costs, losses, damages, claims and expense arising from any failure
to do so.

Reasons for the decision

To allow the SCC land to be transferred to GBC
so that the development of the SANG can proceed.

Alternative options considered

The decision meets the statutory and policy
requirements of the Council for development of the Weyside Urban
Village and there were no alternative options available.
