To enter into the Deed of Grant of Easements
for underground electric lines at land between Bellfields Road
& Waterside Road (1) GBC and (2) South Eastern Power Networks
PLC.
The easements between (1) GBC and (2) South Eastern Power Networks
Plc include the following key terms and conditions:
The Grantees to pay a premium of £1 upon completion.
UKPN's rights granted include:
-lay and maintain electric lines under the Easement Land and
thereafter use, retain, maintain and inspect the electric
lines;
-enter and break the surface of the Easement Land in the exercise
of its rights (subject to reinstatement of the surface to the
Council's reasonable standard as soon as reasonably practicable
without undue delay);
-enter the Grantor's Land with or without vehicles, contractor's
plant, apparatus and equipment at all times via road and accessways
and park on the Easement Land as necessary to exercise its rights
(subject to not obstructing the Grantor's Land);
-support from subjacent and adjacent land of the Grantor;
-fell, lop or top from time to time all timber and other trees,
shrubs, roots on the Easement Land which would otherwise obstruct
or interfere with the laying and maintenance or operation of the
electric lines (and will remove all such timber and other wood
felled, lopped or topper at the Council's request).
UKPN obligations include:
-provide reasonable notice of its intention to carry out works on
the Grantor's Land (save for in the case of emergency);
-insure with a reputable insurer against third party and public
liability;
-not cause any unnecessary damage or disturbance to the Grantor's
Land (making good any damage caused); and
-UKPN also indemnifies the Council for any claims resulting from
negligence or wrongful act/omission in breach of the deed or
arising in exercising its rights.
The Councils obligations include:
-cannot do anything on the Easement Land that may obstruct access
to the electric lines or hinder exercise of rights;
-cannot do anything on the Grantor's Land which would interfere
with or damage electric lines;
-cannot do anything on the Easement Land to interfere or lessen the
support to the electric lines;
-cannot alter or cover the existing level or surface of the
Easement Land in a manner that makes access to / laying of electric
lines impracticable or more difficult (save for the Council can lay
/ relay surfaces that form part of any intended / existing road or
footpath or other accessway after the laying of the electric
lines);
-cannot erect any building or structure (including foundations) on
the Easement Land (other than as shown on the Plan);
-cannot install pipes, drains and other apparatus on / through / in
the Easement Land;
-cannot plant any trees on or which grow over the Easement
Land;
-cannot excavate the Easement Land below 0.35m in depth without
reasonable prior written notification to UKPN, giving UKPN
reasonable opportunity to attend excavations and abiding by UKPN's
reasonable directions to protect the electric lines.

The decision meets the statutory and policy
requirements for the Council and for development of the Weyside
Urban Village and there were no suitable alternative options
available.
