The Council sold 4 Pathfields, Shere,
Guildford GU5 9HP under the Right to Buy on 7 March 2022 with a
discount. In accordance with the Housing Act 1985, the buyer was
obliged to repay a portion of the discount if they sold the
property within five years, any time before 7 March 2027. This
obligation is registered as a charge on the title of the
property.
The property was offered back to the Council in line with the Right
of First Refusal in January 2025. As the Council declined to
repurchase the property, it has been sold on the open market.
The required portion of the discount has been repaid.
Authority is now required to prepare the DS1 (cancellation of
entries relating to a registered charge) in order for the
registered charge to be removed from the title to the
property.

Reasons for the decision

The repayment of discount is a statutory
obligation under the Right to Buy legislation.
