To approve the grant of the occupational
licence of part of Millbrook Car Park, Millbrook, GU1 3YA in line
with the following terms and conditions:
The National Trust and their contractors have sought the
Council’s approval to use part of the car park, comprising 34
car parking spaces, as a site compound for the temporary
installation of a crane, and associated works in connection with
the permanent repair of the Tumbling Weir.
In addition, The National Trust will be required to obtain the
Council’s approval for access from the highway to the site
compound across the car park, and further reasonable access across
the Council’s land between the car park and the weir
structure.
The terms and conditions of the licence are as follows:
The fee of £50,000 (inclusive of VAT) will be payable for a
period of 23 weeks not to end later than the 31/10/2026.
The initial total fee of £50,000 will be payable in
advance.
The licence will permit The National Trust to extend the period of
the licence on a weekly basis at a weekly fee of £2,174
(inclusive of VAT), provided the extension period ends no later
than on the 31/10/2026. If the licence term is extended beyond
31/10/2026, the weekly fee payable will increase to £3,658
(inclusive of VAT).
The weekly fee for the period of the extension of the licence
beyond the initial 23-week period will be payable monthly in
arrears.
The Council will continue to hold a refundable damage deposit of
£20,000 against reinstatement as evidenced by a photographic
schedule of condition.
The National Trust will pay the Council’s legal and
surveyor’s fees.

Reasons for the decision

To regularise the use by The National Trust
and their contractors, of Millbrook Car Park, and other adjoining
land owned by the Council, as a site compound and for access to
carry out works to permanently repair the Tumbling Weir that are
within Permitted Development.
To agree fees to compensate the Council for loss of income from
Millbrook Car Park.
