Chester Bridge/Ash Road Bridge –
decision concerns the easement being granted by Bellway Homes
Limited to Surrey County Council (‘SCC’) and Guildford
Borough Council (‘GBC’) to give SCC and GBC rights of
access in connection with the management and maintenance of Ash
Road Bridge including the flood compensation storage area which is
being retained by GBC.

Reasons for the decision

This easement is being granted pursuant to a
Section 38 agreement relating to Chester Bridge/Ash Road Bridge
which was entered into by GBC with SCC and landowners on 22 June
2023.
That Section 38 agreement requires Bellway Homes Limited to grant
SCC and GBC this easement which will give SCC and GBC the right to
pass over and along that land falling within the Wildflower Meadow
site for all purposes connected with the management and maintenance
of Chester Bridge/Ash Road Bridge. GBC requires this easement
because GBC needs access to flood compensation land which is being
retained by them (land formerly forming part of Orchard Farm) and
this easement will grant GBC the required access rights.
