September 9, 2026 Joint Strategic Director - Economy, Planning and Place (Officer) Key decision Approved View on council websiteFull council record
Purpose
To enter into a Section 38 agreement relating to Phase 1 and 3 Infrastructure as part of Weyside Urban Village.
Decision
That the Joint Strategic Director of Economy, Planning and Place:
Authorises the execution of a Section 38 Agreement between Guildford Borough Council, Surrey County Council and HCC International Insurance Company Ltd and authorises payment of associated statutory fees to Surrey County Council in its capacity as the Highway Authority, in respect of the Phase 1–3 infrastructure works forming part of the Weyside Urban Village development.
Reasons for the decision
The decision is required to ensure that the Council has the necessary agreements in place to progress and address the highways works relating to the Weyside Urban Village (WUV) development.
Alternative options considered
OPTION 2: The Strategic Director could decide to not approve the recommendations outlined in this report, which will mean the Council is ultimately unable to comply with the planning requirements set out in the S106 agreement. This will impact the ability to deliver the scheme, risk delays to programme and the achievement of the Homes England Housing Infrastructure Fund milestone deadlines. This option is not recommended.
