Decision

The Deed of Variation seeks to make a number of minor amendments to the Weyside Urban Village S106 Agreement to enable efficient delivery of the development whilst accounting for programme delivery changes.
•Amend the definition of Commencement of Development to allow the Sustainable Movement Corridor enabling works to proceed without triggering wider Section 106 obligations.
•Introduce a formal definition and plan for the Sustainable Movement Corridor.
•Correct the SANG to Weyside Urban Village Footpath trigger by changing the delivery phase from Phase 6 to Phase 2.
•Amend the Bus Service Phasing Strategy trigger from a pre-commencement requirement to a trigger linked to commencement of residential development.
•Amend Schedule 5 Paragraph 14 so that the associated obligations are triggered prior to occupation of the 271st dwelling. This will enable Phase 1 and 3 to be delivered.
Overall purpose: To facilitate delivery of the Sustainable Movement Corridor, correct drafting anomalies and better align Section 106 triggers with the phased delivery of the Weyside Urban Village.

Reasons for the decision

To amend the Section 106 Agreement to correct drafting anomalies and align planning obligation triggers with the phased delivery of the Weyside Urban Village development, without materially altering the approved scheme.
